Looks new, and comes in a nice retail box covered in plastic and sealed just like it was brand new. SSD showed 1000hrs of power on time and 95% life remaining. Battery looked to be brand new according to windows battery report, and showed 2,000mah above manufacturers design capacity, so I belief it's a brand new battery.
Enjoy!

It is most likely Amazon renewed
I don't know what kind of warranty Microsoft offers, but login to their website with your account and that model number, you know how you would look for a driver and it would do like a self diagnosis or something,
The reason why I'm Saying that is because I got an Amazon renewed hp elitebook 745 G6 really cheaply recently, and it still had six months warranty on it, and I was able to get a free battery replacement.
Personally I would recommend going with the elite book, but surface laptops have some advantages, being extremely thin and light, is nice, but the elite book is 3.3 pounds so that's also light as well, but I understand the appeal of the surface laptop, just saying
